SPARK SCHOOLS’ BURSARY PROMOTION– COMPETITION RULES

  1. Interpretation 
    1. In the Competition Rules, unless the context clearly indicates a contrary intention, the following words will have the following meanings and cognate expressions will have corresponding meanings:
      1. the Act” means the Consumer Protection Act 68 of 2008;
      2. Business Day” means a day other than a Saturday or a Sunday or a day which from time to time is a proclaimed public holiday in the Republic of South Africa;
      3. Competition Rules” means the rules contained herein, as required by Section 36 of the Act;
      4. Participant” means any natural person who qualifies in terms of clause 4.1 hereof and who enters into the Promotional Competition in terms of clause 5 hereof;
      5. POPI” means the Protection of Personal Information Act, No 4 of 2013;
      6. GDPR” means the General Data Protection Regulation of 2018
      7. Promoter” means eAdvance (Pty) Ltd t/a SPARK Schools;
      8. Promotional Competition” means the competition to which these rules pertain as run by the Promoter during the Promotion Period; 
      9. Promotion Period” means the period that starts on 17 September 2018 and closes on 30 November 2018 at 00h00. No late entries will be accepted;
      10. 1.1.10.“Prize” means as further described in clause 6;
      11. Winner” means the Participant who is successful in the Promotional Competition and is notified as such by the Promoter in terms of clause 7.  
  2. Introduction
    1. The Promoter is offering a Promotional Competition in terms of which the Participants can enter the Promotional Competition in order to win the Prize.
    2. The Promoter hereby imposes the following Competition Rules in terms of Section 36 of the Consumer Protection Act.
  3. The Consumer Protection Act
    1. The Competition Rules contain certain terms and conditions which may:-
      1. limit the risk or liability of the Promoter, or any relevant third party; and/or
      2. create risk or liability for the Participant; and/or
      3. compel the Participant to indemnify the Promoter or a relevant third party; and/or
      4. serve as an acknowledgement, by the Participant, of certain facts.
  4. The Participant
    1. The Participant must be;
      1. a natural person and may not be a juristic person; 
      2. 18 years or older; and
      3. a permanent resident or citizens of the Republic of South Africa
    1. This Promotion is open to cell phone users on the South African Vodacom, MTN, Telkom Mobile and Cell C networks.
    2. The Participant, by entering into the Promotional Competition, expressly acknowledges that he/she has been given an appropriate opportunity to first read the Competition Rules before entering the Promotional Competition and that he/she understands and thereby agrees to the Competition Rules.
    3. It is a material term of the Promotional Competition that all Participants’ to this Promotional Competition participate entirely at their own risk.
    4. No director, employee, agent or consultant of the Promoter, or their spouses, life partners, business partners or immediate family members, or the supplier of goods and services in connection with this competition may participate in this competition.
  1. How to enter
    1. Participants may enter via:
      1. a mobile phone through a USSD session (Unstructured Supplementary Service Data), using the method below.
      2. a computer by filling out an entry form, using the details contained below.
    2. The promoter is not liable for the failure of any technical element relating to this promotional competition that may result in an entry not being successfully submitted.
    3. Entries which are unclear, illegible or contain errors will be declared invalid.
    4. No entries before or after the campaign period will be considered.
    5. The competition closes at midnight on the 30th November 2018.

             Mobile Entry

    1. To enter, Participants are required to find the USSD number, and then using a cell phone, dial *120*77275# via USSD (Unstructured Supplementary Service Data). Each mobile entry will cost R0.20 per 20 seconds.
    2. USSD sessions are charged from your airtime or billing balance and costs 20c for every 20 seconds you use the service (Free minutes do not apply). The average time for entry is under 20 seconds so your call should not exceed more than 40 seconds. Please ensure you terminate the session when complete.
    3. An entry will be deemed valid once the Participant has followed all of the prompts during the USSD session. The Participant will then receive a unique referral code SMS and another SMS within 48 hours of completing the USSD session which states that SPARK Schools will reach out to the Participant on the cell phone that was used by the Participant to enter the competition.

              Online Entry

    1. To enter, Participants are required to complete the entry form located at http://www.sparkschools.co.za/win-a-bursary-competition/
    2. An entry will be deemed valid once the Participant has successfully completed the form and has received their unique referral code.
    3. The promoter is not liable for the failure of any technical element relating to this promotional competition that may result in an entry not being successfully submitted.
    4. Entries which are unclear, illegible or contain errors will be declared invalid.
    5. No entries before or after the campaign period will be considered.
  1. The Prizes
    1. A bursary to a SPARK Schools primary school, including full tuition but excluding stationery fees, extra-mural fees, aftercare, uniforms, day-trips or ancillary or related fees. 
    2. The Winner will be given the opportunity to indicate their SPARK (Primary) School of choice. If the Winner’s preferred SPARK School does not have any positions available, the child of the Winner may be placed in the SPARK School nearest to the Winner’s preferred School pending the opening up of a position at the preferred SPARK School. This is at the discretion of the Winner.
    3. The Winners will be selected at the discretion of the Promoter by way of a lucky draw.  In the event that any of the winners cannot be successfully contacted following all reasonable attempts (5 attempts) to do so the Promoter reserves the right to draw another Winner in substitution. Any queries in this regard may be directed to the SPARK Schools head office 010 125 0600.
    4. There are a total of 10 full primary school tuition bursaries to be won
    5. There will be 1 winner drawn per 1 bursary draw. There will be 10 bursary draws. Once all 10 draws have been performed, a “backup draw” will be conducted if, after reasonable efforts, initial winners cannot be contacted or do not accept the Prize. 100 backups will be drawn. The first drawn backup will be first in line to be contacted should an initial winner be unreachable or ineligible to receive the prize. The Promoter will utilize the backup list to fill and award all 10 bursaries. A 2nd backup draw will be conducted should the initial list not fulfil the task of filling the 10 bursaries. In the case that a backup winner is chosen, the initial winner will not be eligible for any share in the prize
    6. A person, identified by the cell phone number or email address, can only win one bursary. If an entrant earns10 entries into the draw via referral entries, and they are chosen as a bursary winner, their 9 other entries will be removed from the subsequent draws for the other Prizes. One bursary per cell phone number / email address. A Winner, or family that wins (regardless of who entered) may only win one prize in this event, i.e. only one bursary will be awarded per family.
    7. There is no cash alternative. The prize is non-transferable and non-changeable. The Promoter reserves the right to substitute a prize of similar or greater value should the circumstances make this necessary. 
  1. Incentives
    1. Airtime prizes (R2 denominations) are only available for existing SPARK Schools parents and may only be redeemed by pre-paid or top-up account holders. Winners with contract accounts may transfer the airtime prize to another pre-paid number of their choice by contacting the head office.
    2. Airtime is available for the following networks – Vodacom/MTN,CELLC,Telkom
    3. BONUS ENTRY
      1. A Participant earns a bonus entry into the bursary draw via the following mechanisms:
        1. – by opting to refer a friend during the USSD or online session and choosing the option “Extra entry into bursary prize draw”
        2. – An initial entrant will earn a further bonus entry per entrant who enters the Competition and opts to enter a referral code received from an initial entrant 
    4. A winner may be asked to confirm their full name, telephone number,  email address, and home address, proof of age and other reasonable information to ensure the winner meets the qualifying criteria
    5. Qualifying criteria is as follows
      1. a natural person and may not be a juristic person; 
      2. 18 years or older; and a permanent resident or citizens of the Republic of South Africa
      3. Must be the parent/guardian of at least one dependant who is able to attend SPARK Schools by virtue of meeting the Schools standard acceptance criteria, and providing the requisite documentation. See the SPARK Schools website for all information relating to acceptance and documentation. 
  1. The Winner
    1. The Winner may be asked to take part in publicity relating to the Promotional Competition, publicity campaigns or allow their names and likenesses to be used for promotional purposes aligned with the Promoter’s business, including but not limited to posting photos to the Promoter’s website, Facebook and other social media pages. The winner may decline such an invitation. 
    2. The Winners may be required to sign a waiver of liability and indemnity before claiming their prizes.  
    3. All Winners will be required to provide their names, ID numbers and contact details and to sign an acknowledgement of receipt of the Prize. The Participants consent, by taking part in the competition to the Promoter using the personal information collected through the competition to adjudicate the competition. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and SPARK School’s privacy policy.
    4. Where Participants/ Winners consent to take part in the Promoter’s publicity campaigns, they will not be entitled to any remuneration for such participation and all materials arising from such participation will be the sole property of the Promoter. At the time that a potential prize winner is identified, the potential prize winner will receive a telephone call from a representative of the Promoters at which point he/she may be required to answer a few questions regarding his/her eligibility as well as be requested to submit certain documents such as a copy of his/her ID and/or driver’s license to the Promoters representative.
    5. The potential prize winner is not an actual winner until his/her submission is validated and his/her documents are completed and submitted to the Promoters. If a potential prize winner does not meet the eligibility requirements, the prize will be forfeited and a runner up finalist will be deemed the potential prize winner subject to the terms and conditions herein. 
    6. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 (“CPA”).
  2. The Rules
    1. The following rules apply to the Promotional Competition:-
      1. the Participants must provide correct and up-to-date personal details as required by the Promoter with each referral sent to the Promoter and allow the Promoter to process such information in terms of POPI, CPA and GDPR; 
      2. the Promoter reserves the right to amend these Competition Rules by bringing it to the Participants attention within a reasonable period of time and may terminate the Promotional Competition at any time. In such event, where the Promotional Competition is terminated or suspended, all Participants agree to waive any rights that they may have in terms of the Promotional Competition and acknowledge that they have no recourse against the Promoter, their employees, agents, partners, suppliers, or sponsors;
      3. in the event of a dispute, the decision of the Promoter will be final and binding and no correspondence will be entered into. In this regard and for further clarity, the Promoter shall be entitled to deal with such disputes (or any failure by Participants to follow the rules) in their sole discretion, including that the Promoter shall be entitled to immediately disqualify Participants from this Promotional Competition. 
      4. Unlawful, fraudulent, or otherwise dishonest conduct or any conduct in breach of these Rules by a Participant and/or their parents/guardians, determined in the Promoter’s sole discretion, may result in disqualification from the Promotional Competition and ineligibility to win any prize.
      5. It is expected that people will enter on a mobile phone that is owned and registered to that person. No other person can use another person’s mobile phone for competition entry purposes. This is to avoid fraud and possible litigation between the phone owner and the entrant.
      6. Therefore each entrant is expected to be the owner of that mobile phone and no singular person can enter off of another mobile phone number. This is to avoid additional fraud being conducted by multiple SIM card owners.
  1. Indemnification 
    1. By entering into the Promotional Competition, the Participant expressly agrees to the following indemnifications:
      1. the Participant indemnifies and holds harmless the Promoter and its promotional partners, their employees and their agents (“the Indemnified Parties”) of any and all liability pertaining to any damage, cost, injuries and losses of whatsoever nature and howsoever arising as a result of their participation in the Promotional Competition and related events and activities, including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation or invasion of privacy; and
      2. the Participant accepts that the Indemnified Parties will not be responsible for any costs, damage or otherwise, howsoever incurred by the Winner subsequent to claiming the Prize.
  1. Prize Qualification Rules
    1. Participation in the Promotional Competition constitutes acceptance of the Competition Rules.
    2. By entering the Promotional Competition Participants consent to their details being used for marketing campaigns by the Promoter.
    3. The Winner will be notified by sms, telephone or email. If winners are uncontactable (due to incorrect contact details) after 10 days or 5 attempts to contact them, their prize will be forfeited.
    4. A Prize may not be handed over to a winner when it is prohibited by law for the winner to use the prize. The Winner must prove their eligibility to use the prize. Once the Winner has been notified and the prize has been handed over, the Winner must sign an acknowledgement of receiving the Prize.
    5. The Participant must inform their employer of his/her participation in the Competition and must obtain consent to participate, if this is required, the Promoter accepts no responsibility in this regard should the Participant have failed to obtain the necessary consent, resulting in their inability to redeem the Prize.
    6. The Winner must provide valid proof of identity (a bar-coded ID book or card, passport or drivers licence).
    7. Any extras not included in the Prize as detailed above will be at the expense of the winner.
    8. The Promoter reserves the right to substitute the Prize with any other prize of similar commercial value to the Prize offered herein, at its sole discretion.

  2. POPI/GDPR
    1. The Winner may consent to the use of his/her name and image in any publicity material. Any personal data relating to the Winner or any other entrants will be used solely in accordance with current Consumer Protection Act (CPA)/ the Protection of Personal Information Act (POPI)/the General Data Protection Regulation (GDPR) and will not be disclosed to a third party without the entrant’s prior consent. 
    2. Entry into the competition will be deemed as acceptance of these terms and conditions. 
    3. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or any other Social Network. 
    4. The Participant by part taking in the Promotional Competition consents to his/her personal information to be shared with the Promoter’s employees, contractors or agents for the purpose of this Promotional Competition.
